Did you know an IID is mandatory for a first DUI conviction?

The Commonwealth of Virginia is serious about keeping drunk drivers off the road. One of the measures found to be very effective is that of installing an ignition interlock device in a vehicle.

State law now requires the use of an IID for any conviction related to alcohol. This means, even if you are a first-time offender, you will have to adjust to driving with an ignition interlock device on board.

The IID and the log

The ignition interlock device is about the size of a mobile phone and connects to the ignition system of your car or truck. You must also have the electronic log equipment installed. The IID includes a breath testing device, and you must breathe into the mouthpiece so that the machine can record your blood alcohol content level. If the reading is higher than 0.02 percent, your vehicle will not start; otherwise, you are on your way.

Further responsibilities

Just because the vehicle will start does not mean you can drive away, then stop somewhere for a beer or to have a glass of wine during lunch with a friend. Keep in mind that the IID will require random samplings as you drive. If you fail the breath test, the device will make the car lights flash and the horn honk until you turn the vehicle off. Keep in mind that installation of an IID will not be the only penalty you face as a first offender. In addition to fines, you must also enroll in the alcohol safety action program.

Fighting for your rights

If law enforcement officers arrest you on suspicion of drunk driving, what caused them to stop you in the first place? What was your physical condition at the time? Did the police officer conduct the breath test properly? You have rights and options other than pleading guilty to a drunk driving offense that would require you to become used to driving accompanied by an ignition interlock device.
