All vehicle occupants in Virginia must use seat belts

Virginia traffic laws exist to promote public safety and mitigate the risk associated with motor vehicle transportation. People who consistently adhere to traffic rules can minimize their risk of a citation and also the chances of a serious collision.

Historically, Virginia has had relatively lenient safety restraint regulations. Only those in the front seat had a legal obligation to wear a seat belt while the vehicle was in motion. As of July 1st, 2025, the law now requires that every occupant, including adults in the backseat of the vehicle, use safety restraints. Children under eight years old also need to be in specialized safety seats, ranging from rear-facing infant car seats to booster seats for older children.

Violating the new Virginia seat belt law is a secondary traffic infraction. The driver is potentially at risk of a $25 citation for each violation. If there are four people without seat belts in the vehicle, the driver may owe $100 in fines.

The secondary status of the safety belt rule means that noticing occupants without seat belts on is not a reason for a police officer to conduct a traffic stop. However, when officers have a reason to stop a vehicle, they can also issue a seat belt citation in addition to any ticket for other traffic offenses they noticed.

People sometimes convince themselves that using a safety restraint in the rear seat is not necessary, as the front row of seats should prevent them from getting thrown from the vehicle in a collision. Despite what people believe, research consistently shows that safety restraints save lives and reduce the severity of collision injuries.
