Statute Of Limitations For Filing Personal Injury Claims

The commonwealth of Virginia has a two-year statute of limitations for filing personal injury claims and lawsuits. This time period starts from the victim’s injury date, with special rules that may apply to certain cases of medical malpractice:

  • If the patient is younger than eight years old, they may file their claim on or before their 10th birthday.
  • If the patient’s condition was misdiagnosed, they may file their claim one year from the date they received an accurate diagnosis.
  • If a healthcare professional left a foreign object inside a patient’s body during surgery, they may file their claim one year from the date they discovered the medical error.
  • If a healthcare professional intentionally prevents the patient from discovering their act of malpractice, the patient may have one additional year from the date of discovery to file a lawsuit.

The statute of limitations for minors is also different from the general rule. For instance, if the injured victim is a teenager, their timeline for filing a personal injury claim begins on their 18th birthday and ends when they turn 20 years old.
